TERMS AND CONDITIONS
1. PURPOSE. By means of this Agreement, the LESSOR makes available to the LESSEE a moped/motorcycle (hereinafter, the “VEHICLE”), as detailed in the Rental Form that forms part of this Agreement.
2. DELIVERY. The LESSOR hereby delivers the VEHICLE to the LESSEE, the model, make, license plate, and other details of which are indicated in the attached Rental Form, along with the damage report, in perfect mechanical working order. The vehicle’s external components will be inspected in the presence of the LESSEE to verify the absence of any scratches or dents. Otherwise, this circumstance will be noted in the Rental Form and cannot be claimed from the LESSEE upon return. However, the LESSEE expressly agrees to be responsible for any other damage that the VEHICLE may sustain upon return, once the Rental period has ended.
3.- RETURN. The LESSEE will return the VEHICLE to the address, date, and time indicated by the LESSOR on the Rental Form, in the same condition as it was received, except for normal wear and tear resulting from proper use. Late delivery will result in a charge of SIXTY EUROS (€60) per hour, calculated in fractions of a minute. Under no circumstances will the LESSOR refund any rental amount if the LESSEE returns the VEHICLE before the scheduled time. If, for justified reasons, including but not limited to misuse of the vehicle, the Lessor requests the Lessee to return the vehicle early, the Lessee agrees to return it as soon as requested, waiving any claim for rental rights. A police report will be filed, and any vehicle not returned within two (2) hours from the initially scheduled time or the time requested by the Lessor will be considered stolen. If the Lessee drives with an expired contract and without the Lessor’s authorization, the contracted insurance will automatically be suspended, and the Lessee will be solely responsible for any damage or claim from that moment on.
4.- MECHANICAL WARRANTY. If the VEHICLE is unable to complete the rental period due to mechanical reasons, the LESSEE understands that the breakdown was due to causes beyond the LESSOR’s control and not due to bad faith. Therefore, the LESSOR will only be responsible for reimbursing the unused rental amount. In any case, the LESSOR may replace the damaged VEHICLE with another, paying or charging the LESSEE the difference in the rental price. The LESSEE hereby waives any other type of claim. In the case of a 125cc scooter, if the VEHICLE is immobilized due to a mechanical breakdown, the LESSEE must contact the roadside assistance company arranged by the LESSOR, and only that company. Charges on behalf of said assistance company will only be accepted in emergencies and when previously authorized by the LESSOR. 5. DRIVER CONDITIONS. The LESSEE, as the driver of the VEHICLE, and the authorized driver, affirm that they are of the age required by the LESSOR to drive the rented VEHICLE, that is, eighteen (18) years of age or older for 50cc scooters or twenty-one (21) years of age or older for 125cc scooters, as well as sufficient driving experience. In this regard, they affirm that they have a valid driver’s license in Spain to drive these types of vehicles. The only valid driving licenses in Spain are those issued in accordance with current Spanish legislation, those issued by Member States of the European Union, and those issued internationally by third countries that are recognized in Spain. Only a DGT digital license is permitted; all other digital licenses are not valid. The LESSEE and authorized driver agree to comply with current legislation at all times. The companion may not, under any circumstances, be under TWELVE (12) years of age.
6. TRANSFER OF THE VEHICLE. The LESSEE may not transfer use of the VEHICLE to third parties, except with the express prior consent of the LESSOR, which must be reflected by including them as additional drivers on the Rental Form. In this case, the LESSEE will always be solely responsible to the LESSOR and third parties for any damages that may occur to and with the VEHICLE, regardless of who was driving it at the time of the damage.
7. USE OF THE VEHICLE. The LESSEE agrees to:
